Edward D. Baker is a trusts and estates litigator representing individuals and families throughout the metropolitan New York area. His practice includes will and trust contests, contested accountings, discovery proceedings, removal proceedings, and guardianship proceedings.
A thorough and experienced litigator, Ed conducts the full range of activities to resolve disputes efficiently, including pretrial discovery, legal research, drafting motion papers, and settlement negotiations. Ed provides sophisticated advice aimed at resolving disputes outside of court if possible, however, should litigation be unavoidable, he is a zealous advocate who will see the matter through trial.
Prevailed on summary judgment to dismiss all objections and successfully argued that a portion of the co-administrator’s legal fees should be apportioned against the Objectant’s share of certain settlement proceeds.
Successfully opposed a motion by respondent’s counsel to vacate a stipulation of settlement entered into between the parties and prevailed on opposing an appeal to the Second Department.
Secured a judgment in excess of $130,000,000 following a bench trial.
Represented a petitioner before the Surrogate’s Court and Appellate Division, First Department, who successfully moved for summary judgment dismissing objections that the propounded will was revoked by a subsequent purported instrument.
Represented a petitioner who successfully moved for summary judgment opposing the respondent’s petition to compel a distribution.
